H & C APPLICATIONS FOR PERMANENT RESIDENCE
H&C applications are usually considered under exceptional circumstances. There is no guarantee that application for PR under H&C will be approved. Various factors are considered before making a determination on H&C applications. In case if the application is refused, the only recourse is through Federal Court to review the decision.
Factors to be Considered
In H&C applications, IRCC usually considers the following factors to establish whether there are compelling circumstances to grant PR under humanitarian and compassionate grounds.
- Degree of establishment in Canada
- Degree of applicant’s integration into the community through community organizations, volunteer work or other activities
- Best interest of any child affected by your application
- Consequences of your separation from relative
- Factors in applicants home country
Where your application is approved, you will be required to clear medical and police examinations to obtain your permanent residence card. In case your applications is rejected, you will have 15 days to appeal the decision to the Federal Court of Canada if you feel there are further reasons to be considered.
